Unlike
Apartment "Equity Programs" that takes years to receive
the same benefits, with Metro's New Home Buyer Program
you can receive the full Program Amount in as little as 1 month
(short Term Lease qualifies) when you use us or one of our
affiliated agents as your Buyer Agent for your New Home
purchase.
Whenever
any Metro customer who has leased an Apartment, Duplex, Condo,
Town-home or House through our Rental Locator Service buys a
"New
Home" and lists us as their referral agent that customer
qualifies to receive a check or credit at Closing representing 2%
of your New Home's purchase price! What this means is that after
negotiating your best deal with the builder you will receive 2% of
that sales price from us at closing! Based on a $200,000 dollar
home this could mean $4,000 dollars in cash back to you at
closing. A Rebate of 1% applies to existing home purchases.
If
you have not leased an Apartment or Home through our Locator
Service standard rebates of 1% to 1.5% depending on whether
new or pre-owned home will apply:

RULES AND GUIDELINES
-
You
must Lease an Apartment, Duplex, Condo, Townhome or House
through our FREE Locator Service and list us as your Referral
Source on your Lease Application and contact us with your new
lease information. Once our Rental Invoice is paid you will
automatically become eligible to receive 2% of your New
Home's sales price at Closing through our "New Home
Purchase Money Program." There is no charge to register
and you may use our Free Customer Searchable New
Homes databases and/or ask your agent for listings and
assistance .

The
Apartment or House you lease from must offer a Referral
Commission for you to become eligible for a 2% New Home
Rebate.

You
must satisfy the terms of your lease agreement. Short term
leases that we place and receive a referral fee for will also
qualify for our 2% Rebate Program.

This
offer is open ended and extends forward in time to all
customers who have leased an apartment through one of Metro's
full-service locator services and have satisfied numbers 1, 2
and 3 above.

This
program will not affect any Apartment Specials, Monthly Rent
or your Apartment Selection. This program is a benefit to
our Apartment Customers.

There
are no minimum monthly rent payment requirement to become
eligible and there are no monthly "equity"
accumulation to keep track of.

The
2% Rebate program applies only to New Homes and only
to builders who pay us the common industry commission on the
new home you buy. 1% Applies to any pre-owned home listed in
the MLS System and which pays a minimum 3% agent
commission. If Metro does not receive a commission from
the builder for any reason, Metro is not obligated to rebate
anything. Furthermore, the builder must consent to the details
of this program. (Almost all builders will consent to this
program!)

This
program does not apply to "For Sale by Owner" homes
unless a 3% sellers commission is offered. Again 1% Rebates
apply to "pre-owned" homes.

It
is your responsibility to obtain mortgage "Pre-Approval"
before you begin your house hunting (Click

We do not show homes for sale until you have been
Pre-Approved. Pre-approval allows you to understand the extent
of your borrowing power and how much home you can afford. We
can recommend quality Lenders or you can work with Lenders of
your choice to obtain "pre-approval."

You
may be required to sign a "Non-exclusive Buyer
Representation Agreement" with Metro Relocation Services
whenever you elect to use this program. The rebate
is subject to the consent of the person the licensee
represents. Under a Buyer Representation agreement you are the
PRINCIPAL and YOU make the AUTHORIZATION allowing us to REBATE
2% back to you. If
the area you are seeking to purchase a home is outside of our
market areas another comparable Real Estate service may be
used to fulfill the terms of this agreement. That Real Estate
Service may require an "Exclusive Buyer Representation
Agreement" in order to offer their services. To

The
funds due to the home buyer under this program represent a
"Rebate of Commission" and come from the Agent's
commission at closing.

Under
our 2% REBATE PROGRAM our services to you are limited
to referral services only. This means Metro provides the time
saving means that enables you to SEARCH for EXISTING
or NEW
HOMES from your own computer. It is through your use of
this online Referral technology where you search and visit new
area homes for sale that we are able to pass this huge
Rebate Benefit onto you.

To
receive your 2% Rebate it is your responsibility when you
visit a NEW HOME BUILDER to list us as your Real Estate Agent
on your first visit and all subsequent paperwork. Some builder
may require our representative to be present at the first
visit so it is important to let us know where you plan to
visit when you go looking and if you stop by a community that
requires our presence to let us know as soon as
possible. We will fill out any necessary paperwork
required by the Builder and ask you to choose how you want the
2% paid to you. IF

Our
Program can not be used in combination with any other equity
program that requires you to list another Broker to obtain
their program benefits. If we are not listed as YOUR Sole Real
Estate Agent no program benefits will be paid.

"Home Purchase Money Program" is subject to any
limitations or restrictions imposed by the Texas Real Estate
Commission (TREC). Program terms and conditions may be changed
from time to time. However there is no expiration of this

Texas Association of Realtors® provides the following information
for you:
Real estate brokers and salesmen are required by
law to make properties available without regard to race, color,
religion, national origin, sex, disability or familial status.
Prior to entering into a contract, a buyer may find it useful to
pre-qualify for a mortgage loan. Loan programs, fees, interest
rates and requirements vary among lenders.
Brokerage fees are negotiable and are not fixed or controlled.
In many transactions, including most residential sales, a seller
will deliver a Seller's Disclosure Notice to a buyer on or before
the effective date of a contract to purchase the property The
notice provides important information about the seller's knowledge
of the property condition.
Buyers, sellers, landlords, or tenants are encouraged to have a
property inspected by licensed inspectors or lawfully authorized
persons to determine- (a) the condition of the property;
(structural, mechanical, and electrical items); (b) any
environmental conditions; (c) feasibility of use; (3) compliance
with laws or regulations; (e) presence of termites or
wood-destroying insects; and (f) any other matters. Brokers are
not qualified to perform such inspections.
Residential service contracts are available to buyers and sellers
of residential property. In a residential service contract, a
residential service company agrees to, subject to the terms of the
contract, repair the appliances, electrical, plumbing, heating,
cooling or other systems in the property.
Buyers are advised to obtain a policy of title insurance or have
an abstract of title reviewed by an attorney of buyer's choice
before purchasing a property.
Buyers, sellers, landlords, or tenants are advised to seek the
advice of an attorney of their own selection before entering into
a binding agreement.

Texas
law requires all real estate licensees to give the following
information about brokerage services to prospective buyers,
tenants, sellers and landlords.
Before working with a real estate broker, you should know that the
duties of a broker depend on whom the broker represents. If you
are a prospective seller or landlord (owner) or a prospective
buyer or tenant (buyer), you should know that the broker who lists
the property for sale or lease is the owner's agent. A broker who
acts as a subagent represents the owner in cooperation with the
listing broker. A broker who acts as a buyer's agent represents
the buyer. A broker may act as an intermediary between the parties
if the parties consent in writing. A broker can assist you in
locating a property, preparing a contract or lease, or obtaining
financing without representing you. A broker is obligated by law
to treat you honestly.
IF THE BROKER REPRESENTS THE OWNER:
The broker becomes the owner's agent by entering into an agreement
with the owner, usually through a written listing agreement or by
agreeing to act as a subagent by accepting an offer of subagency
from the listing broker. A subagent may work in a different real
estate office. A listing broker or subagent can assist the buyer
but does not represent the buyer and must place the interests of
the owner first. The buyer should not tell the owner's agent
anything the buyer would not want the owner to know because an
owner's agent must disclose to the owner any material information
known to the agent.
IF THE BROKER REPRESENTS THE BUYER:
The broker becomes the buyer's agent by entering into an agreement
to represent the buyer, usually through a written buyer
representation agreement A buyer's agent can assist the owner but
does not represent the owner and must place the interests of the
buyer first. The owner should not tell a buyer's agent anything
the owner would not want the buyer, to know because a buyer's
agent must disclose to the buyer any material information known to
the agent.
IF THE BROKER ACTS AS AN INTERMEDIARY:
A broker may act as an intermediary between the parties if the
broker complies with The Texas Real Estate License Act. The broker
must obtain the written consent of each party to the transaction
to act as an intermediary. The written consent must state who will
pay the broker and, in conspicuous bold or underlined print, set
forth the broker's obligations as an intermediary. The broker is
required to treat each party honestly and fairly and to comply
with The Texas Real Estate License Act. A broker who acts as an
intermediary in a transaction:
(1) shall treat all parties honestly;
(2) may not disclose that the owner will accept a price less than
the asking price unless authorized in writing to do so by the
owner;
(3) may not disclose that the buyer will pay a price greater than
the price submitted in a written offer unless authorized in
writing to do so by the buyer; and
(4) may not disclose any confidential information or any
information that a party specifically instructs the broker in
writing not to disclose unless authorized in writing to disclose
the information or required to do so by The Texas Real Estate
License Act or a court order or if the information materially
relates to the condition of the property.
With
the parties' consent, a broker acting as an intermediary between
the parties may appoint a person who is licensed under The Texas
Real Estate License Act and associated with the broker to
communicate with and carry out instructions of one party and
another person who is licensed under that Act and associated with
the broker to communicate with and carry out instructions of the
other party.
If you choose to have a broker represent you, you should enter
into a written agreement with the broker that clearly establishes
the broker's obligations and your obligations. The agreement
should state how and by whom the broker will be paid. You have the
right to choose the type of representation, if any, you wish to
receive. Your payment of a fee to a broker does not necessarily
establish that the broker represents you. If you have any
questions regarding the duties and responsibilities of the broker,
you should resolve those questions before proceeding.
